Trafficking in Firearms

OFFENCE

The trafficking of a firearm, or the possession of a firearm for the purpose of trafficking, involves the manufacturing or transferring of the firearm or the possession of the firearm for the purpose of transferring it. It does not require that there be any consideration for the transfer of the firearm. The simple act of giving it to another person would be sufficient. In this regard, trafficking of a firearm is analyzed in much the same way as narcotics.

 

 

 

PENALTY

The trafficking in firearms carries a mandatory minimum jail sentence of 3 years for a first offence and 5 years for a subsequent offence. The maximum penalty in either case is 10 years in jail.
